"In a decision that could have far-reaching implications, a federal court in Pennsylvania has held that the California arbitration clause in the 'take it or leave it' clickwrap agreement on the Second Life website is unconscionable, and therefore unenforceable. In its decision (pdf) in Bragg v. Linden Research, Inc., No. 06-4925 (E.D. Pa. May 30, 2007), the Court concluded that the Second Life 'terms of service' seek to impose a one-sided dispute resolution scheme that tilts unfairly, 'in almost all situations,' in Second Life's favor. As a result, the case will stay in Pennsylvania federal court, instead of being transferred to an arbitration forum in California."

Last week we asked you for questions to pass on to Turbine CEO Jeff Anderson, about their recently released Lord of the Rings Online Massively Multiplayer Online Game. There were a ton of great queries, and unfortunately Mr. Anderson had only a limited time to spare for us. Over the phone we still managed to discuss a wide variety of topics, including: their use of the license, lessons learned from the Asheron games, World of Warcraft impact on the genre, what Tolkien would have thought, and whether or not they're working on a Linux/Mac client. Make sure to give them a look, and many thanks again to Mr. Anderson for taking the time to speak with us.

The tour was a whirlwind: dancing at a beachside disco in Spain surrounded by scantily clad women, grabbing a seat at a lively pub in Dublin, flying in a small aircraft above a lush, tropical forest.
Time elapsed? Less than two hours.
With no tickets required, no money spent and no need to leave your seat, touring in the virtual world of Second Life holds a certain appeal for travellers willing to delve deep into the internet to find their escape.
Visitors need only download a free program, then log in. With the help of elaborate 3-D locales designed and built by the world's residents, tourists can watch their online embodiments - known as "avatars" - lounge on the beach, dine at a romantic restaurant, or dance in a crowded nightclub.

In the 21 months that I have been a citizen of Second Life, much has changed. SL is no longer a just a RPG hang out. Real life is encroaching, and the best we can do it roll with the punches. Some times I applaud the Lindens, other times I just shake my head in wonder. But a recent conversation with a well respected, dear friend who just attended the LL Job Fair in Boston, just blew me away. Here is an inside peek at what is actually going at the recruiting station for happy land. My friend wishes to remain anonymous - and please remember this is only one side of the story - maybe it was all a dream?
